Things You Should Know About Renting in Dubai!

In Dubai, many landlords issue eviction notices and ask tenants to vacate the property. Tenants face the risk of imminent eviction and the challenge of finding a new home. But is it within the landlord’s rights to request that a tenant vacate the property in Dubai?

According to Law No. 26 of 2007, known as the “Law Regulating the Relationship Between Landlords and Tenants in the Emirate of Dubai”, a landlord can request a tenant to vacate the rented property by giving notice through a notary public 12 months in advance.

However, if the following conditions occur, the landlord can request the tenant to vacate the property before the lease agreement expires:

  • If the tenant fails to pay the rent or part of it within 30 days of receiving the landlord’s notice of payment.
  • If the tenant sublets the real estate or any part of it to another person without obtaining the landlord’s written consent. In this case, the eviction applies to the secondary tenant, who has the right to seek compensation from the primary tenant.
  • If the tenant uses the property for illegal purposes or for purposes that violate public order or morality, or allows others to use it for such purposes.
  • If the tenant makes alterations to the property that endanger its safety, makes it impossible to restore it to its original condition, intentionally damages the real estate, or causes damage through gross negligence or failure to exercise proper care, or allows others to cause such damage.
  • If the tenant uses the property for purposes other than those for which it was leased by the landlord, or uses it in a manner that violates the planning, construction, and land use laws in Dubai, this is considered a breach of the lease agreement.
  • If the tenant fails to comply with any obligations imposed by this law or the terms of the lease agreement within 30 days of receiving the landlord’s notice.

After the lease agreement expires, the landlord can request the tenant to vacate the property if the following conditions occur:

  • A competent government entity requests the demolition and reconstruction of the real estate based on Dubai’s urban construction requirements.
  • The property requires complete reconstruction or major repairs that cannot be done while the tenant is occupying it, provided that the condition of the real estate is confirmed by a technical report approved by the Dubai Municipality.
